Introduction
Next Nature Museum makes every effort to ensure that visits to the museum and the exhibitions and activities organised by Next Nature run as smoothly as possible. In doing so, Next Nature Museum observes the greatest care towards all its visitors. We strive to keep any nuisance or inconvenience to a minimum and to guarantee the safety of every visitor as well as possible.

Article 1 – General provisions: definitions
1.1 Next Nature Museum: The organisation that manages and operates the museum, including, but not limited to, the management, public and catering staff and other persons authorised to act on behalf of this organisation.
1.2 Museum: The entirety of spaces (built and unbuilt), located in the Evoluon at Noord Brabantlaan 1A, which falls under the legal or management authority of the board of the Next Nature Foundation, including, but not limited to, exhibition and event spaces, restaurant and other outdoor space.
1.3 Visitor: Anyone who enters the museum and/or visits an exhibition or attends an activity organised by Next Nature or by third parties with the permission of Next Nature in the museum as an invited guest, including anyone who enters the museum in the case of room rental, catering and/or shop visits.
1.4 Agreement: The legal relationship that arises as soon as a visitor enters the museum (either as a paying visitor or as a guest), makes a purchase via the webshop or enters into a membership as a Supporter, to which these terms and conditions apply.
1.5 Ticket: The (digital) proof that, whether or not for payment, has been provided by or on behalf of Next Nature and entitles access to a specific activity, space or time slot during opening hours.
1.6Webshop: The official online sales environment of Next Nature, accessible via the website, where the visitor can conclude agreements at a distance for the purchase of our services and products. The webshop includes the full digital process of selection, secure payment and automated delivery.
1.7 Supporters: The natural person (Supporter, Friend or Family) who enters into an agreement with the Next Nature Foundation for structural support. Upon cancellation, permission is requested to make contact again in the future and the supporter is informed of the right to be forgotten.
Article 2 – Applicability
2.1 These terms and conditions apply to all visits, purchases, reservations and supporter memberships. The visitor conditions also apply to special activities within or outside regular opening hours and/or aimed at others than the regular visitor, such as in the case of room rental, catering and shop visits.
2.2 Deviations from these terms and conditions are only valid if they have been expressly agreed in writing.
Article 3 – Access to Next Nature Museum
3.1 The visitor is only entitled to enter the spaces of the museum via the designated entrances and paths upon presentation of a valid ticket (or digital supporter pass).
3.2 Admission tickets become invalid by the mere passing of the time or period stated on the admission ticket, unless otherwise agreed or if Next Nature decides otherwise.
3.3 Next Nature may refuse access if the visitor is clearly under the influence of alcohol/drugs, clearly disturbs the peace, or does not behave in accordance with public order, good morals or rules of decency.
3.4 Next Nature reserves the right to subject every visitor and their luggage to an access control (search). A visitor who refuses to cooperate can be denied access without the right to a refund.
3.5 Taking dangerous objects (such as firearms, pointed/sharp weapons, blunt objects or dangerous substances such as explosive or toxic agents) is prohibited. Prohibited objects that fall under a legal ban will be handed over to the police.
Article 4 – House rules and stay
4.1 Visitors must immediately follow the directions and instructions given by Next Nature employees.
4.2 Children under the age of 13 may only visit the museum if accompanied by an adult. Parents, teachers and supervisors are at all times responsible and accountable for the behaviour of their children or group members.
4.3 In the museum it is not permitted: Smoking (except at designated locations), consuming food or drinks (except in the restaurant/terrace), and touching objects that are explicitly partitioned off with fences, ribbons or display cases. It is also not permitted to hinder other visitors by noise nuisance or to obstruct the view of objects.
4.4CCTV: A camera system is operational in the museum for the safety of persons and the collection. Visitors agree that recordings will be made; images are stored for a maximum of 4 weeks in accordance with the GDPR, unless necessary for longer in the event of an incident.
Article 5 – Guided Group and School Visits
5.1 Schools and groups are required to book in advance for a guided visit. For groups from education, the rule is 1 supervisor per 15 students, unless otherwise agreed in writing.
5.2 If the size of a group changes to more than 15 people, additional costs apply due to the deployment of an extra guide/facilitator. Changes must be reported at least 7 days prior to the visit.
5.3 Cancellation: A booking for schools can be changed or cancelled in writing up to 7 days before the visit. For groups, this period is 14 days.
5.4 Delay by the customer: In the event of a delayed start caused by the customer, the full duration of the activity cannot be guaranteed; the original end time will be maintained. In the event of an excessive delay, Next Nature may cancel the activity without the right to a refund. All additional costs arising from the delay or the rescheduling of the activity shall be borne by the customer.
Article 6 – Sales, Withdrawal and Refunds
6.1 Ticket sales: In accordance with Art. 6:230p of the Dutch Civil Code, there is no right of withdrawal for tickets. Tickets already obtained cannot be exchanged and no refund will be given in the event of loss, theft or non-use of a ticket.
6.2 Webshop: For physical items in the webshop, a legal cooling-off period of 14 days applies in accordance with Art. 6:230o of the Dutch Civil Code. Next Nature applies a return policy for purchases via the webshop with a maximum of 30 days; please refer to the webshop sales conditions for this.
6.3 Refund exclusion: Next Nature is never obliged to provide a refund or compensation for, among other things: objects from the collection not being visible, partial closure (e.g. for setup/dismantling), nuisance from other visitors, maintenance work or the failure of facilities to function properly, unless mandatory law dictates otherwise.
Article 7 – Liability and Force Majeure
7.1 Staying in the museum is at the visitor's own account and risk.
7.2 Next Nature is only liable for property/consequential damage or injury that is the direct result of intent or gross negligence, limited to the maximum amount for which Next Nature is insured.
7.3 Liability is excluded for damage caused by the actions of third parties, the failure to follow instructions from staff or damage to vehicles.
7.4 Force Majeure: Next Nature is not liable for damage caused by force majeure, including fire, terrorism, strikes, weather conditions, pandemics or disruptions in public transport.
7.5 The visitor is liable for all direct and indirect damage they cause to the collection, the building, the inventory, or employees of Next Nature, whether or not as a result of intent, gross negligence, or non-compliance with the house rules and instructions.
7.6 Parents, teachers, or group supervisors are jointly and severally liable for damage caused by the persons under their supervision, without prejudice to the individual liability of the person who caused the damage.
Article 8 – Privacy and Intellectual Property
8.1 Personal data is processed in accordance with the GDPR. Data is stored for as long as legally required (including fiscal retention obligation).
8.2 All rights to content and exhibitions rest with the museum. Commercial disclosure or reproduction of photo and film recordings is prohibited without prior written permission from the management.
8.3 Next Nature may create atmospheric images for reporting and promotion based on legitimate interest. If a visitor is recognisably in the picture and objects, Next Nature will no longer use the material in question.
8.4 Visual material and atmospheric images: Next Nature may create atmospheric images for reporting and promotional purposes. We do so based on a legitimate interest for marketing. If a visitor is recognisably in the picture and objects to this, Next Nature will remove the material in question upon first request and will no longer use it.
8.5 Intellectual Property: All rights to the content, exhibitions, and website of Next Nature rest with the foundation. The commercial disclosure or reproduction of photo and film recordings is prohibited without prior written permission from the management.
Article 9 – Lost property
9.1 Lost property can be handed in at the reception. Valuable items are registered and kept for 3 months; thereafter they are transferred to the municipality or a charity.
9.2 Official documents (passports, ID cards) are handed over to the Eindhoven police after 24 hours. Debit cards, Museum-and Vriendenloterij cards are kept for 2 weeks and then destroyed.
9.3 Objects of low value (such as water bottles, scarves, umbrellas), for which the owner does not report within a month, are destroyed or donated to a charity.
Article 10 – Complaints and Disputes
10.1 Complaints must be submitted in writing within 6 weeks after the visit via office@nextnature.net or the contact page on the website.
10.2 Next Nature investigates the complaint and answers it in writing within 5 working days (or at the latest within 14 days if further investigation is required).
10.3 Dutch law applies exclusively to the agreement between the visitor and Next Nature.
10.4 All disputes arising from the agreement will be submitted to the competent judge of the District Court of East Brabant.
Article 11 – Legal Notice & Website Terms of Use
11.1 Identification data: In accordance with the information obligation, the owner of the website is the Stichting Next Nature Network. The foundation manages various domains, including nextnature.net, evoluon.com, lettertohumanity.org, ecocoin.com and related sites as stated in the privacy policy.
11.2 Acceptance: Access to the website requires acceptance of the terms of use currently in force on the website.
11.3 Intellectual Property: The source code, graphic designs, images, photos, animations, software and texts on the websites are protected by Dutch legislation in favour of Next Nature. Reproduction, modification or distribution without prior written permission is prohibited.
11.4 Limitation of Liability: Next Nature accepts no liability for damage arising from the use of the website content or external links (hyperlinks, framing). This is the exclusive responsibility of the user.
11.5 Reservation: Next Nature reserves the right to change website information at any time or to temporarily suspend access for maintenance or improvement work.
Article 12 – Specific Conditions for Supporters
12.1 Membership levels & Benefits:
- Supporter (€25/yr): Personal digital pass, monthly editorial, annual magazine, 10% webshop discount, exclusive discounts at events.
- Friend (€45/yr): All Supporter benefits plus unlimited access to exhibitions and 2 free guest tickets per year.
- Family (€65/yr): All Friend benefits, whereby the digital pass offers unlimited access for the entire family (living at the same address).
12.2 Payment & Direct Debit: The member authorises Next Nature to collect the costs annually via direct debit. One receives a reminder 10 days in advance. In case of non-payment, the membership is automatically deactivated.
12.3 Duration & Cancellation: Cancellation is possible at any time via the account page or members@nextnature.net The account remains active until the end of the billing period; no (partial) refund will take place.
12.4 Changes: Next Nature reserves the right to change these conditions, rates and benefits at any time.
Article 13 – Final Provision
If one or more of the aforementioned articles are or prove to be no longer legally valid, the remaining provisions remain in force. In that case, a new provision that corresponds as much as possible will replace the lapsed provision(s).
